Terms of Use

1. Acceptance of Terms

By creating an account, accessing, or using any part of the MoonTrip platform, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you are using the platform on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you may not use the platform.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. By using MoonTrip, you represent and warrant that you meet these requirements.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information during registration and to keep it up to date.
• You must notify us promptly if you become aware of any unauthorised use of your account.
• We reserve the right to suspend accounts that show signs of compromise in order to protect your data.

4. Permitted Use

MoonTrip is a platform designed for travel agencies to manage quotes, bookings, itineraries, invoices, payments, and related operations. You agree to use the platform only for its intended purpose and in compliance with all applicable laws. You may not:

• Use the platform for any unlawful, fraudulent, or harmful purpose.
• Attempt to gain unauthorised access to any part of the platform or its systems.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Transmit malicious code, viruses, or any content designed to disrupt the service.
• Use automated tools such as bots or scrapers to access or extract data from the platform.
• Resell, sublicense, or redistribute access without our prior written consent.

5. Your Content & Data

You retain full ownership of all data you enter into the platform, including customer records, booking details, itineraries, invoices, and financial data (“Your Content”). You grant MoonTrip a limited, non-exclusive licence to host, store, and process Your Content solely to provide and improve our services. We will not use Your Content for any other purpose. Our handling of your personal information is described in our Privacy Policy.

6. Intellectual Property

The MoonTrip platform, including its design, source code, features, logos, trademarks, and documentation, is the intellectual property of MoonTrip and is protected by applicable intellectual property laws. These Terms do not transfer any ownership rights in the platform to you. All rights not expressly granted herein are reserved by MoonTrip.

7. Subscription & Billing

• MoonTrip offers both free and paid subscription plans. Plan details, pricing, and features are available on our Pricing page.
• Paid subscriptions are billed in advance on a monthly or annual basis. All fees are quoted in Indian Rupees (INR) and include applicable GST unless stated otherwise.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
• We may adjust pricing with at least 30 days' prior notice. Continued use after a price change constitutes acceptance.
• If a payment fails, we may suspend access to paid features after providing reasonable notice and an opportunity to update your payment method.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The platform may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. Where possible, we will provide advance notice of planned downtime. We are not liable for any loss arising from service interruptions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOONTRIP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid to MoonTrip in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MOONTRIP DOES NOT WARRANT THAT THE PLATFORM WILL MEET YOUR SPECIFIC REQUIREMENTS, OR THAT GENERATED INVOICES, TAX CALCULATIONS, OR ITINERARIES WILL BE FREE OF ERRORS. YOU ARE RESPONSIBLE FOR VERIFYING ALL FINANCIAL AND TAX DOCUMENTS BEFORE RELYING ON THEM.

11. Indemnification

You agree to indemnify, defend, and hold harmless MoonTrip and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms or any applicable law; or (c) any content you submit through the platform.

12. Termination

Either party may terminate this agreement:

• By you: You may close your account at any time through the account settings or by contacting support.
• By us: We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice.

Upon termination, your right to use the platform ceases immediately. You may request an export of Your Content within 30 days of termination — data will be provided in a standard format (CSV or JSON). After this period, we will delete Your Content from our active systems, except where retention is required by law.

13. Force Majeure

Neither party shall be liable for failure or delay in performing its obligations where caused by events beyond reasonable control, including natural disasters, pandemics, government actions, war, civil unrest, internet or telecommunications failures, or power outages. The affected party shall promptly notify the other and use reasonable efforts to mitigate the impact.

14. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in India. Before initiating formal legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of at least 30 days.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MoonTrip regarding your use of the platform.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and notify you by email at least 15 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the revised Terms.
